Is it just kidding; just joking; or just workplace harassment in disguise?

The recent media coverage of some of the worst examples of inappropriate workplace behaviour is difficult to ignore. Spanning across the sectors and impacting on organisations as wide ranging as Oxfam and the Presidents Club and as far afield as Hollywood, campaigns including #MeToo and #TimesUp have shone the spotlight more brightly than ever before, on workplace harassment.

Against this backdrop, the key issue for employers is dealing with the shift in culture that this increased awareness is creating. The focus is now on addressing inappropriate behaviour head on, and tackling it towards resolution rather than concealing it because of embarrassment, not wanting to rock the boat, or being fearful of jeopardising future career opportunities. So how should organisations tread this dividing line? And it is very much a divide: the sceptical viewpoint might be that staff will jump on this high profile bandwagon to make a quick buck, so let’s do nothing; the alternative is that employers want to retain their people, to keep them engaged, and avoid the fallout in terms of both cost and recruitment, of inappropriate behaviour and subsequent litigation.

Delivered by Helen Iles, solicitor and trainer, and Gareth Petty, Director at ACAS, this session will blend legal knowledge with practical skill; Helen will outline the legal framework underpinning workplace behaviour and discuss the key case law decisions which have filtered down from the Courts and Tribunals, so that organisations are aware of the standards expected of them. Gareth will then explain how these standards should be met on a day to day basis, with best practice advice on implementation and risk management.
